NY LIVINGSTON — Livingston Zoning Board advances Mid-Hudson Fiber variance to January hearing. The board unanimously voted to move an area variance application for the telecom utility to a public hearing scheduled for January 13, 2026, contingent on deed restrictions limiting the proposed 0.05-acre parcel at 2356 U.S. Route 9 to telecom use only.
Board Member David Kimball and Attorney Andrew Howard raised concerns about setting precedent for such a small lot and proposed adding a right of reverter protecting against future non-telecom development. The application seeks to convert an existing easement into direct ownership for Mid-Hudson Fiber's equipment, represented by Kaaterskill Associates.
